These Terms of Service (“Terms”) govern your access to and use of Forest Battle Merge and related services. By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. Agreement and Eligibility

1.1 Acceptance of These Terms

Hobbying Inc. (“Hobbying,” “we,” “us,” or “our”) provides the mobile game Forest Battle Merge and related features (collectively, the “Service”). If you do not agree to these Terms, do not use the Service.

1.2 Eligibility

You must be legally permitted to use the Service where you live. If you are not old enough to enter into a binding agreement, you may use the Service only with the consent and supervision of a parent or legal guardian.

1.3 Changes to These Terms

We may update these Terms to reflect changes to the Service, law, security, or our operations. We will provide reasonable advance notice of material changes when required. If applicable law requires separate consent, we will request it.

2. Accounts and the Service

2.1 Accounts

On first launch, the Service first shows nickname setup and the required notices. An anonymous Firebase guest account is created only after you choose to start. You may optionally link Google or Apple from the Account tab in Settings to recover progress on another device. If you do not link a social account, you may be unable to access or recover guest progress after reinstalling the app or changing devices. You are responsible for safeguarding your account and device and promptly notifying us of suspected unauthorized use.

2.2 Limited License

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Service for non-commercial entertainment purposes.

2.3 Service Availability and Changes

The Service includes gameplay, character collection and progression, rankings, and ranked or friendly matches. We may modify, suspend, maintain, or discontinue features for operational, technical, legal, or security reasons. We will provide notice of foreseeable material changes where reasonably practicable.

2.4 Account Deletion

You may delete your account through Settings > Account > Delete Account. Active account and gameplay data under our control cannot be recovered after deletion. Records required by law and limited security logs or backups are handled as described in our Privacy Policy.

3. Acceptable Use and Community Safety

3.1 Prohibited Conduct

You may not:

• impersonate others, misuse another person’s account, or submit fraudulent information;
• exploit bugs, use bots or modified clients, interfere with servers, or gain an unfair advantage;
• harass, threaten, discriminate against, or expose personal information about another person;
• post or transmit illegal, sexual, child-harm, hateful, phishing, advertising, or spam content;
• infringe intellectual property, privacy, or other rights; or
• violate applicable law or these Terms.

3.2 Nicknames, Multiplayer, and Reports

Your nickname may appear in rankings and player-to-player matches. Multiplayer quick chat is limited to phrases provided by us; free-form chat is not available. You may report or block another user through the in-game controls. Hobbying’s Customer Support Team aims to conduct an initial review within 24 hours after receiving a report, but this is not a guaranteed resolution time. Appeals may be sent to support@hobby-ing.com with relevant account and action details.

3.3 Enforcement

Based on severity, repetition, intent, and impact, we may issue a warning, reset a nickname, restrict a feature, suspend an account for 1, 7, or 30 days, or permanently terminate access. We may skip intermediate steps for child sexual exploitation, credible threats, doxxing, phishing or fraud, serious hateful incitement, repeated serious violations, or evasion of enforcement.

4. Virtual Content and Intellectual Property

4.1 Virtual Items

Gems, gold, essences, tickets, characters, and other virtual content are licensed for use only within the Service. They have no cash or cryptocurrency value, do not represent ownership, and may not be exchanged for money. The current release contains no advertising and no in-app purchases. We will update the applicable disclosures and terms before introducing paid content.

4.2 Ownership

The Service, software, artwork, audio, trademarks, and other content are owned by Hobbying or the applicable rights holder. Except for the limited license above, no right is transferred to you. You may not copy, distribute, modify, reverse engineer, or commercially exploit the Service except where applicable law expressly permits it.

4.3 Third-Party Services

Authentication, hosting, networking, and other features may rely on Apple, Google, Firebase, Cloudflare, or other providers. Their own terms and privacy policies may apply to their services.

5. Termination and Liability

5.1 Termination

You may stop using the Service or delete your account at any time. We may restrict or terminate access for a material violation of these Terms, unlawful activity, security risk, or where necessary to protect users or the Service. If we permanently discontinue the Service, we will provide notice as required by applicable law.

5.2 Disclaimers

To the fullest extent permitted by law, the Service is provided on an “as is” and “as available” basis. We do not promise that the Service will always be uninterrupted, error-free, or available on every device. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

5.3 Limitation of Liability

To the fullest extent permitted by law, Hobbying is not responsible for indirect, incidental, special, consequential, or punitive damages arising from circumstances beyond our reasonable control, including network failures, third-party platform outages, force majeure, or your own acts. This section does not limit liability that cannot be limited under applicable law.

6. General Terms and Contact

6.1 Governing Law and Disputes

These Terms are governed by the laws of the Republic of Korea, without depriving you of mandatory consumer protections available where you reside. The parties will first try to resolve disputes in good faith. Any unresolved dispute will be submitted to a court with jurisdiction under applicable law.

6.2 Severability and No Waiver

If any provision is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
